Terms of Service

1. ELIGIBILITY

You must be at least 13 years old to use Moodarc. If you are under the age of majority in your jurisdiction, you must have your parent or legal guardian's permission to use the App.

You represent that you have the legal capacity to enter into these Terms and that you will comply with all applicable local, national, and international laws.

2. USER ACCOUNTS AND SECURITY

To use most features of Moodarc, you must create an account. You may sign in using Google Sign-In, Sign in with Apple, or email magic link, as made available on your device.

You are responsible for:

• Maintaining the security of the device and accounts used to access Moodarc
• All activity that occurs under your Moodarc account
• Ensuring your account information is accurate and up to date

You agree to notify us immediately at support@joinmoodarc.com if you suspect unauthorized access to your account.

We reserve the right to suspend or terminate accounts that violate these Terms or pose a safety risk to other users.

3. USER-GENERATED CONTENT (UGC) POLICY

Moodarc is a community built on authentic and respectful expression. To ensure a safe environment, we maintain a strict, zero-tolerance policy regarding objectionable content.

By using Moodarc, you agree not to post, share, or transmit any Moments, Moods, Chats, Nudges, or other content that contains:

• Hate speech, discriminatory language, or harassment
• Nudity, sexually explicit content, or pornography
• Violence, glorification of self-harm, or promotion of illegal activities
• Spam, scams, or fraudulent material
• Impersonation of another person or entity
• Content that infringes another person's intellectual property or privacy rights

Safety features available in the App:

• Block Users: You can block any user, preventing them from viewing your profile or interacting with you.
• Report Content and Users: You can flag and report inappropriate Moments, Chats, or profiles directly within the App.
• Developer Action: We review reports of objectionable content. Upon confirming a violation, we will act within 24 hours by removing the offending content and permanently banning the user who posted it, where appropriate.

You are solely responsible for the content you post. We do not pre-screen all content but reserve the right to remove any content and suspend any account at our discretion.

4. INTELLECTUAL PROPERTY

A. Your Content

You retain ownership of the content you post on Moodarc. By posting content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute that content solely for the purpose of operating and providing the Service to you and your connections (followers and Archs).

B. Our Content

The Moodarc name, logo, app design, and underlying software are owned by us or our licensors. You may not copy, modify, distribute, or reverse-engineer any part of the App without our written permission.

5. ACCOUNT SUSPENSION AND TERMINATION

A. By You

You may delete your account at any time through Settings in the App. See our Privacy Policy for details on what data is deleted.

B. By Us

We may suspend or permanently terminate your account, with or without notice, if you:

• Violate these Terms or our UGC policy
• Engage in conduct that harms other users or the Service
• Attempt to circumvent safety features (such as blocks or bans)
• Use the App for illegal purposes

Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination (including disclaimers, limitations of liability, and governing law) will survive.

6. DISCLAIMER OF WARRANTIES

Moodarc is provided on an "AS IS" and "AS AVAILABLE" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the App will be uninterrupted, error-free, or free of harmful components, or that content available through the App will be accurate or reliable.

7. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Moodarc Team and Moodarc shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of or inability to use the App.

Our total liability to you for any claims arising from these Terms or your use of the App shall not exceed the greater of (a) the amount you paid us in the 12 months before the claim, or (b) one hundred U.S. dollars (USD $100). If you have not paid us anything, our total liability is USD $100.

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

8. GOVERNING LAW AND DISPUTES

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict-of-law principles.

Any disputes arising out of these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts located in India, unless applicable law in your jurisdiction requires otherwise.

9. CHANGES TO THESE TERMS

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Effective Date" at the top of this document. For significant changes, we may notify you through the App or by other reasonable means.

Continued use of the App after changes take effect constitutes your acceptance of the updated Terms.
